What Do You Mean You're Intestate?

The above question is one that you will never hear directed at you.  Like the question, "Are you sleeping?" you would be physically incapable of answering "yes."  A person, and more specifically, a person's estate becomes intestate at the moment they pass away without a will.  A person's estate is the after-life sum total of all personal assets and debts that the person owned at the time of passing.  Having passed, the person who owned possessions, now becomes a decedent who has an estate.

 

Is the state of intestacy bad and being testate good?  That depends on the effect on the family, friends, or the State which must handle winding up the affairs of the decedent.  If there is no family, no friends, and no will, the decedent's estate will likely become a matter for the State to handle.  After removing money from the estate to cover possible medical debts, other claims, and burial (or cadaver donation to medical schools), the State will keep the balance of the estate.  Though bleak, that could be a good thing for that decedent, having not burdened any other person with their end of life affairs, having paid off debts, and having (fairly) paid the balance of their assets to the State.      ...read more

Please be aware that the applications for the race will be made available tomorrow, Saturday, The Ides of March, in the early Sunday edition of the Atlanta Journal Constitution. If your application is mailed on Saturday, you'll most likely get in. The July 4th Road Race is the world's largest 10K.
